OMMA VQ TERMS OF USE
1. Definitions
- Omma: Refers to Softalive Bilişim Hizmetleri Sanayi ve Ticaret Anonim Şirketi A.Ş.
- Omma VQ Platform (Data Processor): The software product that enables the end user to view information regarding themselves or their commercial enterprise in video format, depending on the services provided by our customer.
- Customer (Data Controller): Refers to the company/institution that is a customer of Omma.
- End User (“You”): Refers to the real person viewing content through the VQ platform.
- Internal Data: Refers to the data belonging to the end user located within our customer’s own systems.
- External Data: Refers to non-personal information obtained from the connected device, such as location, weather, and local time, as well as anonymous responses provided during interaction.
2. Roles and Responsibilities under Data Protection Laws (KVKK/GDPR)
Within the scope of the services provided, the Customer acts as the Data Controller, responsible for obtaining necessary explicit consents and fulfilling disclosure obligations toward End Users. Omma acts as the Data Processor, processing data solely upon the Customer’s request and for the technical execution of the service.
3. Subject and Scope of Service
- The Omma VQ Platform prepares and presents content created by combining internal and external data upon the customer’s request.
- Content is generated only at the moment of request. It is not recorded, stored, or kept by Omma under any circumstances.
4. Data Usage and Intellectual Property
- Intellectual Property: All software, algorithms, and interface designs of the VQ Platform belong to Omma. All trademarks, logos, and specific Internal Data provided by the Customer belong to the Customer.
- Anonymity: Omma does not perform any operation intended to identify the real person behind the End User profile.
5. Obligations of the Customer
The Customer is exclusively responsible for the legality, accuracy, and integrity of the Internal Data provided to the Platform. The Customer guarantees that they have the necessary legal basis (consent or legitimate interest) to transfer this data to the VQ Platform.
6. Rules of Use
The end user, while using the Omma VQ Platform, accepts, declares, and undertakes that:
- They will use the service only for their own needs,
- They will not engage in behaviors that are contrary to legislation or law, violate the rights of third parties, or constitute abuse,
- They will not make any attempt to damage or interrupt the service. Attempts to access unauthorized data will result in legal action.
7. Limitation of Liability
- The accuracy and currency of the reports generated using the Omma VQ Platform depend on the internal data provided by the customer and the external data received from the device. Therefore, Omma does not guarantee that the report content will be complete, accurate, or uninterrupted.
- Under no circumstances shall Omma be liable for any general, special, direct, indirect, incidental, consequential, or any other damages (including loss of profits or business interruption) arising from the use or inability to use the content or the Omma VQ Platform, including but not limited to performance errors, omissions, defects, interruptions, malfunctions, delays in operation or transmission, computer viruses, or system failures that are not reasonably attributable to Omma.
8. Amendments
Omma reserves the right to make changes and updates to the terms of use. Updates and changes become effective from the moment they are published. Therefore, we recommend that you review these terms of use each time you use the Omma VQ Platform.
9. Governing Law and Dispute Resolution
These terms of use and all rules regarding your use of the Omma VQ Platform are governed by Turkish Law. Istanbul (Central) Courts and Execution Offices shall have jurisdiction over any disputes arising from these terms of use and the use of the Omma VQ Platform.
